JOB TITLE: County Attorney GRADE 20 DEPARTMENT: County Attorney FLSA STATUS: Exempt REPORTS TO: Board of County Commissioners GENERAL DEFINITION OF WORK: Performs complex professional and administrative work providing legal advice to the Board of County Commissioners of Washington County and its boards, commissions, departments, agencies, and employees and represents the County before State and Federal courts and administrative agencies.
Supervision is exercised over all department personnel.
Reports directly to the Board of County Commissioners.
ESSENTIAL FUNCTIONS/TYPICAL TASKS: (These are intended only as illustrations of the various types of work performed.
The omission of specific duties does not exclude them from the position if the work is similar, related, a logical assignment to the position.
) Counsel and advise County Commissioners and County employees.
Represent the County in litigation before State and federal courts and administrative agencies and manage legal matters in which the County is represented by outside counsel.
Negotiate contracts, agreements, and leases Draft, interpret and enforce utility and land use Prepare and review real estate and other legal documents.
Draft laws, resolutions, policies, ordinances, rules and regulations for the County Perform legal research Attend meetings (day and evening) of the County Commissioners and other bodies to provide legal counsel Respond to citizen inquiries Prepare legislative package to be presented to Local Delegation of the General Assembly Provide legal counsel to County Commissioners and senior staff regarding local government and corporate rights and obligations.
Prepare and present agenda items at Board of County Commissioners’ meetings Ensure that the County’s intent is accurately expressed in all contractual and personnel matters Provide legal advice to members of the staff relevant to County operations Draft and review instruments affecting real property, financing, contracts, legislation, pleadings, decisions of various boards and commissions and other legal documents agreements that have legal consequence.
Supervise personnel within the department Prepare performance evaluations and goal setting for all department staff Prepare an annual operating budget; monitor and approve expenditures Represent the County in labor negotiations and disputes Advise the County on employment law issues that arise on a day to day basis; such as, employee discipline, employee investigations, evaluation of policies and procedures, issues arising under the employee handbook, and employee termination decisions.
Perform related work as required KNOWLEDGE, SKILLS AND ABILITIES: Thorough knowledge of local government law, legal research, principles of substantive law and civil and administrative procedure.
Ability to understand and analyze varied factual scenarios and legal materials, present logical conclusions from analysis and develop creative approaches to problem solving.
Ability to develop and maintain effective working relationships with co-workers, media representatives, government officials and the public.
Strong and effective communications, research and writing Demonstrate knowledge of employment law Experienced in union negotiations, issues and grievances Preference may be given to those with intermediate to advanced computer skills, particularly with respect to Microsoft Office, Westlaw computer-assisted legal research, and computer-based case management EDUCATION AND EXPERIENCE: Graduation from an accredited law school Admission to practice law in the State of Maryland Extensive experience as a practicing attorney in the State of Maryland A comparable amount of training and experience may be substituted for the minimum qualifications.
PHYSICAL REQUIREMENTS: This work requires fingering and repetitive motions; vocal communication is required for expressing exchanging ideas by means of the spoken word; hearing is required to perceive information at normal spoken word levels; visual acuity is required for preparing and analyzing written computer data, determining the accuracy and thoroughness of work, and observing general surroundings and activities.
SPECIAL REQUIREMENTS: Must be licensed to practice law in the State of Maryland, a member in good standing of the Maryland Bar, has not been the subject of adverse bar disciplinary actions, and is in compliance with all other requirements prescribed by statutes, rules and regulations applicable to the practice of law.
Must also be a Washington County, Maryland resident have the ability to meet the residency requirement within six (6) months of employment.
Possession and the ability to maintain a valid Maryland driver’s license.
